PlumbWorks Plumbing Service Terms & Conditions

These Plumbing Service Terms & Conditions (“Agreement”) govern all plumbing services provided by PlumbWorks (“Contractor,” “we,” “our,” or “us”) to the customer (“Customer,” “you,” or “your”). By approving an estimate, scheduling service, signing a work order, making payment, or authorizing work verbally, electronically, or in writing, you agree to be bound by this Agreement.
1. Scope of Services
PlumbWorks will perform only the services specifically described in the approved estimate, proposal, invoice, or work order.
Any work not expressly included is excluded from the scope of work unless approved as a change order under Section 3.
Descriptions, pricing, and recommendations are based upon conditions that are reasonably visible at the time of inspection.
2. Estimates
Unless otherwise stated in writing:

Estimates are valid for thirty (30) days.
-
Material pricing may change due to supplier cost increases.
-
Estimates are based upon visible conditions only.
-
Estimates do not include concealed defects or unforeseen conditions.
-
Additional work may be required if hidden conditions are discovered.
An estimate is not a guarantee that additional work will not become necessary.
3. Change Orders
If additional work becomes necessary because of:

concealed plumbing,
-
hidden damage,
-
code requirements,
-
customer requests,
-
unsafe conditions,
-
inaccessible piping,
-
structural limitations, or
-
other unforeseen circumstances,
PlumbWorks will provide the Customer with a revised estimate whenever reasonably practicable before performing the additional work.
Customer approval may be provided verbally, electronically, by text message, email, signature, or other documented communication.
Additional approved work will be billed separately.
4. Concealed or Unknown Conditions
Plumbing systems are frequently concealed within walls, ceilings, slabs, crawl spaces, and underground utilities.
PlumbWorks is not responsible for conditions that were not reasonably discoverable before work began, including but not limited to:

hidden leaks;
-
deteriorated piping;
-
corrosion;
-
mold;
-
structural damage;
-
code violations;
-
improperly installed plumbing;
-
asbestos-containing materials;
-
hazardous materials;
-
underground obstructions; or
-
utility conflicts.
Discovery of concealed conditions may require additional labor, materials, permits, or inspections.
5. Customer Responsibilities
The Customer agrees to:
-
provide accurate information regarding the plumbing system;
-
disclose known defects or prior repairs;
-
provide safe access to the work area;
-
maintain utilities necessary to perform the work, including water and electricity;
-
secure pets before service;
-
remove valuable or fragile items from the work area;
-
obtain approvals from landlords, property managers, or homeowners’ associations when required.
Delays caused by Customer responsibilities may result in additional charges.
6. Site Access
The Customer shall provide PlumbWorks with reasonable and uninterrupted access to the worksite during scheduled service hours.
If access is delayed, denied, or restricted after technicians arrive, PlumbWorks reserves the right to charge applicable trip fees, labor charges, or rescheduling fees.
Unsafe working conditions may result in suspension of work until conditions are corrected.
7. Permits and Inspections
Where required by applicable law, PlumbWorks will obtain permits specifically included within the approved scope of work.
Government inspections are conducted by the applicable jurisdiction and are outside the control of PlumbWorks.
Inspection scheduling by governmental agencies may affect project completion dates.
8. Final Inspection and Operational Testing
Upon completion of the work, PlumbWorks will perform a reasonable operational inspection and testing of the completed installation, repair, or replacement to verify functionality based upon the completed scope of work.
The Customer is encouraged to participate in the final walkthrough and ask any questions regarding operation or maintenance.
Completion of this inspection helps ensure that any visible issues can be promptly addressed.
9. Customer Refusal of Final Inspection
If the Customer declines, prevents, postpones, or otherwise refuses PlumbWorks’ reasonable opportunity to complete the final inspection or operational testing:
-
the work may be considered substantially complete based upon the completed installation;
-
PlumbWorks shall not be responsible for conditions that would reasonably have been identified during the refused inspection;
-
any workmanship warranty may be suspended until the inspection is completed, where reasonably possible; and
-
PlumbWorks reserves the right to require a return service visit before warranty coverage becomes effective.
Nothing in this section limits rights that cannot legally be waived under applicable law.
10. Limited Workmanship Warranty
Unless otherwise stated in writing, PlumbWorks warrants its workmanship for twelve (12) months from the date of substantial completion.
This warranty applies only to defects resulting directly from PlumbWorks’ workmanship.
The warranty does not cover:
-
normal wear and tear;
-
customer misuse;
-
abuse;
-
freezing;
-
improper maintenance;
-
chemical damage;
-
corrosion unrelated to workmanship;
-
acts of God;
-
modifications performed by others;
-
damage caused by unrelated plumbing failures;
-
clogged drains resulting from customer use; or
-
work performed by third parties.
PlumbWorks will determine, in its reasonable discretion, whether a claimed warranty issue falls within this warranty.
Repair or replacement of defective workmanship shall be the Customer’s exclusive remedy.
11. Manufacturer Warranties
Products, fixtures, water heaters, pumps, valves, and equipment installed by PlumbWorks may carry warranties provided solely by their manufacturers.
Manufacturer warranties are separate from PlumbWorks’ workmanship warranty.
PlumbWorks makes no additional warranty regarding products beyond any warranty expressly provided by the manufacturer.
12. Payment Terms
Unless otherwise agreed in writing:

Payment is due upon completion of service.
-
Larger projects may require deposits or progress payments.
-
Accepted payment methods may include cash, check, credit card, ACH, or other approved methods.
Failure to make timely payment constitutes a breach of this Agreement.
13. Late Payments and Collections
Past-due accounts may be subject to:
-
reasonable late charges where permitted by law;
-
collection costs;
-
reasonable attorney’s fees;
-
court costs; and
-
other lawful expenses incurred in collecting unpaid balances.
PlumbWorks reserves the right to suspend future work until outstanding balances have been satisfied.
14. Limitation of Liability
To the fullest extent permitted by Utah law, PlumbWorks’ total liability arising out of any claim related to the services provided shall not exceed the amount paid by the Customer for the specific services giving rise to the claim.
PlumbWorks shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of business, lost profits, loss of use, water damage beyond the scope of our workmanship, or delays caused by circumstances beyond our reasonable control.
Nothing in this Agreement excludes liability that cannot legally be limited under applicable law.
15. Force Majeure
PlumbWorks shall not be liable for delays or failures to perform resulting from events beyond our reasonable control, including but not limited to:
-
severe weather;
-
natural disasters;
-
utility interruptions;
-
supplier shortages;
-
labor disputes;
-
governmental actions;
-
pandemics;
-
transportation disruptions; or
-
other force majeure events.
Performance shall resume as soon as reasonably practicable.
16. Customer Property
While reasonable care will be exercised, PlumbWorks is not responsible for pre-existing damage to floors, drywall, landscaping, cabinetry, concrete, tile, or other building materials that must be disturbed to access concealed plumbing.
Reasonable restoration directly included within the approved scope of work will be performed. Cosmetic repairs not expressly included are the responsibility of the Customer.
17. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Utah, without regard to conflict-of-law principles.
Any legal action arising from this Agreement shall be brought in a court of competent jurisdiction located within the State of Utah.
18. Severability
If any provision of this Agreement is held unenforceable, the remaining provisions shall remain in full force and effect.
Any unenforceable provision shall be modified only to the extent necessary to make it enforceable while preserving its original intent whenever possible.
19. Entire Agreement
This Agreement, together with the approved estimate, invoice, work order, warranty documentation, Privacy Policy, and any written change orders, constitutes the complete agreement between the Customer and PlumbWorks concerning the services provided.
No verbal statements or prior discussions shall modify this Agreement unless confirmed in writing by an authorized representative of PlumbWorks.
20. Electronic Acceptance
The Customer agrees that authorization provided by electronic signature, online approval, email, text message, customer portal, recorded telephone authorization, payment of an invoice, or other electronic means constitutes acceptance of this Agreement and shall have the same force and effect as an original handwritten signature under the Utah Uniform Electronic Transactions Act (UETA) and other applicable law.
